Terms and conditions governing the sale of preparatory courses and related educational services through www.chcinamedicinu.cz, concluded in accordance with Section 1746(2) of Act No. 89/2012 Coll., the Czech Civil Code.

1.1. For the purposes of these Terms and Conditions, a Course means any in-person preparatory course designed to prepare participants for entrance examinations to medical faculties in the Czech Republic, including:
Year-Long Course, Winter Course, Spring Course, Summer Course, Medical Mock Entrance Exams, Mini Course (hereinafter referred to as the "Course").
1.2. A Teaching Hour means a continuous teaching session lasting 60 minutes, unless stated otherwise.A Replacement Teaching Hour means a teaching session scheduled outside the regular course timetable.Unless expressly stated otherwise, any reference to a Teaching Hour in these Terms and Conditions also applies to a Replacement Teaching Hour.
1.3. An Instructor means a person with the appropriate professional knowledge and experience in the relevant subject area who provides instruction as part of the Course (hereinafter referred to as the "Instructor").
2.1. The Provider agrees to provide the Participant with educational services related to preparation for entrance examinations to medical faculties in the Czech Republic.Instruction consists of systematic guidance provided by an Instructor for the purpose of preparing the Participant for the entrance examinations within the selected Course.
3.1. The Provider determines the schedule and location of the Course. The Participant will be informed of the Course schedule and location before entering into the Agreement. Should the Course location change before or during the Course, the Provider shall inform the Participant without undue delay via email.
3.2. The service period begins on the Course start date and ends upon completion of the Course, covering the agreed number of Teaching Hours.
3.3. By entering into this Agreement, the Participant is entitled to attend a total of .......... Teaching Hours.A detailed timetable will be provided during the first lesson.
3.4. The Course officially begins on the date when the Participant receives access credentials to the online learning platform, not on the date of the first classroom lesson.
3.5. Access credentials are generally provided 7 days before the Course begins, unless otherwise agreed individually.
4.1. The Parties agree on a Course fee of ........... CZK/EUR (in words: ................................ Czech crowns/Euros).The Parties acknowledge that this fee is final and includes all costs associated with the provision of the Course and related services.
4.2. The Participant agrees to pay the Course fee in full within 7 days of submitting the registration form by bank transfer to the Provider's bank account.Payment shall be deemed received on the date the funds are credited to the Provider's bank account.
4.3. If the Participant registers more than 30 days before the Course start date, the full Course fee is payable within 7 days of submitting the registration.
4.4. If the Participant registers between 30 and 21 days before the Course start date, the full Course fee is payable within 5 days of submitting the registration.
4.5. If the Participant registers between 21 and 14 days before the Course start date, the full Course fee is payable within 3 days of submitting the registration.
4.6. If the Participant registers less than 14 days before the Course start date, the full Course fee is payable on the next business day following submission of the registration.
4.7. The Provider is entitled to issue and deliver invoices electronically via email.
4.8. If the Participant fails to comply with the payment terms, the Provider is entitled to claim reimbursement for demonstrable costs incurred as a result of such failure, up to a maximum of 50% of the Course fee.
5.1. The Provider undertakes to ensure the proper organisation and delivery of the Course.The Provider shall be solely responsible for all activities related to the organisation of the Course, either directly or through an Instructor. These activities include, in particular:
(a) commencing and delivering the Course on the scheduled dates determined by the Provider, including reviewing and explaining model questions used in entrance examinations for Czech medical faculties;
(b) conducting assessments and evaluating Participants' performance.
5.2. The Provider shall inform Participants of any changes to the Course schedule or the scheduling of a Replacement Teaching Hour via the Discord platform or any other communication platform used by all Participants.
5.3. The Provider reserves the right to modify the Course arrangements, including its content, venue, schedule, or Instructor.Any such changes shall not affect the guaranteed quality, scope, or professional standard of the Course.
5.4. If the Provider is unable to deliver a scheduled lesson due to circumstances on its side (such as an Instructor's illness or other serious reasons), the Provider shall notify the Participant at least 24 hours before the scheduled Teaching Hour and propose a replacement date.
Notification published in the Course communication group on Discord (or another communication platform used by all Participants) shall also be deemed valid notice.
5.5. The Provider does not guarantee that participation in the Course will result in admission to a medical faculty.
6.1. The Participant has the right to attend the Course in person.
6.2. The Participant agrees to pay the agreed Course fee in accordance with Section 4 of these Terms and Conditions.
6.3. The Participant agrees not to disrupt the Course or interfere with its proper delivery.
6.4. The Participant shall be liable for any damage caused to the Provider or to third parties during the Course.
6.5. The Participant agrees to maintain the confidentiality of all study materials and other content made available during the Course and shall not distribute, reproduce, or share such materials with any third party.
6.6. The Participant may not transfer their Course registration to another person without the prior written consent of the Provider.
7.1. The Participant has the right to withdraw from this Agreement within 14 days of submitting the registration form without stating any reason, provided that the withdrawal is made no later than 28 days before the Course start date. The withdrawal must be submitted by email to info@chcinamedicinu.cz. In such case, the Provider shall refund the full amount paid by the Participant within 30 days of receiving the withdrawal notice by bank transfer to the account specified by the Participant.
7.2. The following cancellation fees shall apply if the Participant withdraws from the Agreement after the period specified in Section 7.1:
a) If the Participant withdraws 15 or more days after submitting the registration, but no later than 28 days before the Course start date, the Provider is entitled to retain 50% of the Course fee as a cancellation fee.
b) If the Participant withdraws between 27 and 14 days before the Course start date, the Provider is entitled to retain 75% of the Course fee.
c) If the Participant withdraws 13 days or less before the Course start date, or after the Course has commenced, the Provider is entitled to retain 100% of the Course fee.
7.3. For the purpose of processing refunds, the decisive date shall be the date on which the refund is transferred from the Provider's bank account.Refunds will be processed after the Participant submits a cancellation request. If no such request is submitted, the decisive date shall be the date on which the Provider receives the Participant's cancellation email.
7.4. The Course is deemed to commence on the date the Participant receives access credentials to the online learning platform, not on the date of the first lesson. If the Participant withdraws from the Agreement after receiving access credentials, the Provider is entitled to retain 100% of the Course fee.
7.5. Cancellation fees are intended to cover administrative and organisational costs incurred in connection with the preparation and delivery of the Course.
7.6. If the Participant fails to attend the Course, they shall not be entitled to any refund or to transfer the payment to another Course.
7.7. The Provider reserves the right to exclude a Participant from the Course in the event of a serious breach of these Terms and Conditions or generally accepted standards of conduct.In such a case, the Participant shall not be entitled to any refund of the Course fee.
7.8. If in-person teaching cannot take place due to force majeure or other unforeseen circumstances (such as a pandemic), the Provider reserves the right to replace classroom instruction with an alternative form of teaching of comparable quality, such as online instruction.
7.9. If the Provider cancels the Course in its entirety (for example, due to insufficient enrolment), the Provider shall refund the full Course fee paid by the Participant within 30 days of the decision to cancel the Course.
8.1. These Terms and Conditions, as well as any rights and obligations arising from or in connection with them, shall be governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Czech Civil Code, as amended.
8.2. These Terms and Conditions constitute the entire agreement between the Provider and the Participant concerning the subject matter hereof, unless expressly stated otherwise.
8.3. The Agreement becomes valid and binding upon submission of the online registration form via www.chcinamedicinu.cz.
8.4. The Provider reserves the right to amend or supplement these Terms and Conditions at any time.Any amendments shall become effective on the date they are published on the Provider's website, unless stated otherwise.
